These conditions apply to wine and other goods bought from Arrowsmith Winery Inc., 37 Industrial Way, Suite 104, Buellton, California 93427.
Who we are and our licence
Arrowsmith Winery Inc. is a California corporation trading from 37 Industrial Way, Suite 104, Buellton, CA 93427. We hold a California Department of Alcoholic Beverage Control licence, number 638068, Type 02 (Winegrower). All sales of alcoholic beverages are made under that licence and are subject to California law.
How to order
Wine is ordered through this website. Our shop and wine club are operated for us by Commerce7, which handles the basket, checkout, account and club allocations; you will see their pages within our site when you order. Wines are allocated first to wine club members, and whatever remains is released for general sale.
Placing an order is an offer to buy. A contract is formed when we send you an order confirmation and accept payment, and we may decline an order, in which case any payment taken is refunded in full. Age and identification
We sell alcoholic beverages only to people aged 21 or over. By placing an order you confirm that you are 21 or over and that the person receiving the delivery will also be 21 or over. An adult signature is required on delivery and the carrier will ask for government-issued photographic identification. Deliveries cannot be left unattended. If nobody of legal age is available to sign, the wine will be returned to us, and redelivery or return costs may be charged to you.
Where we can ship
We ship only to states where we are lawfully permitted to do so, and the quantity limits set by the destination state apply. We will tell you before taking payment if we cannot ship to your address. Please make sure that receiving the wine is lawful where you live.
Prices and availability
Prices are quoted in US dollars and exclude shipping and any state or local taxes, which are added at the point of sale. Production is small and vintages sell out. We cannot guarantee availability, and a quoted price applies only to the order for which it was given.
Payment
Payment is taken in full at checkout by card, processed by the payment provider used by Commerce7. We do not see or store your full card details. Prices are in US dollars; sales tax and shipping are calculated at checkout according to the destination.
Title to the wine passes to you on delivery.
Delivery
We give delivery estimates in good faith but cannot guarantee dates. We may hold shipments during periods of extreme heat or cold to protect the wine, and will tell you if we do.
Cancellation, damage and faults
You may cancel an order at any time before it is dispatched, for a full refund. Once wine has been dispatched it cannot be returned because you have changed your mind: it is a perishable product and we cannot resell it once it has left our control.
If wine arrives damaged, or a bottle is faulty, tell us within 14 days of delivery and keep the bottle and its contents. We will replace it or refund it. Nothing in these conditions affects your statutory rights.
Wine club
Wine club allocations, frequency, pricing and payment are administered through Commerce7, and the terms applying to your membership are set out when you join. You may cancel at any time from your account or by contacting us, with effect from the next allocation. We will always tell you before an allocation is charged.
Liability
Our liability in respect of any order is limited to the price paid for the goods concerned. Nothing here limits liability that cannot lawfully be limited.
Complaints
Write to us at the address below or email tim@arrowsmithwine.com. We will acknowledge your complaint and aim to resolve it promptly.
Governing law
These conditions are governed by the laws of the State of California, and the courts of Santa Barbara County have jurisdiction over any dispute.
